Gene Peek never denied firing the shot that killed his son, but a Porter County jury Monday did not find enough evidence to convict him of murder. Peek, 57, of Portage, offered assorted rambling excuses for the shooting. He first told police he shot his son, Rodney, after a night of drinking, out of self-defense. Peek shot his 29-year old son with a .22 caliber rifle April 1, 1992.But when he testified last week, he described an accidental shooting, which forced his defense attorneys to alter their case midway through the week-long trial.
The jury deliberated 4 1/2 hours Monday before returning with a not guilty verdict. Defense attorney Robert Harper said he believes the jury was swayed by Rodney Peek's history of violence, evidence that the gun was pointed away from Rodney Peek when at least one shot was fired, and the failure to prove that the killing was intentional.
